The Study On The Public Participation System Of Urban Planning

In our country , the adverse effect of the non-science urban planning on the environment has been appearing gradually .The urban planning means great to environmental protection. This paper tries to design the public participation system of urban planning from the environmental protection visual angle , so as to ensure the realization of the environmental protection goal of the urban planning .The paper makes analysis to the urban planning at first, draws the environmental problem that the urban planning might be caused, and then analyses the reason of this kind of urban planning fault. In the reality of the urban planning, may present two kinds of cases: First, the urban planning does not represent public interests at all; Second, the urban planning represents the public economic interests, but ignores public environmental interests. Both these two cases will produce environmental problem or hinder environmental problem from resolving. So the author draw the conclusion, to solve the fault of the urban planning, it should perfect the system and give environmental protection more concerns at first and secondly, offer more channel from which environmental demand can express. So we need design the relevant systems of urban planning from the environmental protection visual angle and let the public participate in urban planning. Then, round this conclusion, the author tries to prove the justice, feasibility and necessity of the public participating in urban planning through the analysis of jurisprudence, political foundation and current situation of urban planning. Finally, regarding this conclusion as the guidelines and design concrete system, the paper considers urban planning and environmental protection as an organic whole, aims at constructing the public participation system of urban planning. While designing the system under the frame " law of urban planning ", regulations includes the legislative purpose, general regulations, the procedural regulations of the public participation in master plan and detailed plan, and the redress of public interests, theseregulations could let the public participate in the whole course of establishment, decision-making, implements and supervision of planning. In addition, the paper has discussed the range of participating public and the impact of information publicity participating. Accordingly, the paper gives relevant suggestions to corresponding parts of public participation in urban planning of "environment law" and " environmental impacts assessment law".
