The Protection Of Criminal Law On Patent Institution

In the time of knowledge economy ,the importance of the protection of patent is beyond doubt,and the criminal protection of patent becomes the focus in the academic circles.But because of the relatively stronge speciality of and the fomerly unadequate study ,there are some misunderstandings and blind areas in the concerning theories .Beginning with the analyse of the constuction of patent institution,the dissertation discriminates relationships and diffences between patent institutions,protectional institutions of patent rights and other management institutions of patent and points out that the expression on the subject of the illegal infringements upon patent rights cannot cover all the illegal activities infringing upon patent institutions ,and puts forward the concept of the crime upon patent institution.Through the analyse of the problems in the judicial practices and the comparation of the concerning regulations on patent institution between our contry and others ,the dissertation points out that the home current problems existing in the protection of patent institution can be not only attributed to the drawbacks in legislature ,but also to uncorrect concepts on enforcement and observance of the laws. In the last part ,the dissertation puts forward audaciously some tentative ideas on the improvement of our contry's criminal protection of patent institution.
