Comparative Research On Juvenile Judicial System Between China And Russia

The juvenile judicial system was generated and developed form the late 19 century, esp. after the World War II due to the increasing upsurges of juvenile delinquency had come to be a severe social problem. At present, the juvenile delinquency is becoming into a serious international problem which is not only involved in one or several countries. Therefore, it arouses the deep concern of the whole world to prevent and control juvenile delinquency.Many countries have established their juvenile system respectively; despite it is a continuous process of development and improvement. Nowadays, our research on this subject is still considerable superficiality so that it could not adapt to the urgent requirement of the practices of legislation and judicatory. In our country, the population of Juvenile is approximately 400, 000,000 and about 1/3 of the whole population. Since the 90's of last century, out country have put emphasis on the theory and practice of the protection of juvenile's rights and interests as well as juvenile delinquency, successively issued Protective Law of Juvenile, Precautious Law on Juvenile Delinquency and Prison Law. There are special regulations on conviction, proceeding and execution to juvenile delinquency. At the same time, Supreme People's Court, Supreme People's Procuratorate, Ministry of Public Security, Ministry of Justice have also distributed lots of related judicial explanation and guided documents which have played a certain effective role though there is considerable gap compared with other countries.Referred to legislation and practice, Russia's juvenile judicial system has considerable rationality and originality. Comparative research is one of the methods to study this subject, so called advice from others may help one to overcome one's shortcomings as stones from other hills may serve to polish the jade of this mountain. The present thesis aims to the exploration of the theory and practice of juvenile judicial system of other countries and drawing lessons form the things of universality and regulation.All these should be beneficial to the deploitation of our relevant research field and the enrichment of the criminal science of China. This thesis tries to compare and analyze the characteristics of juvenile legislation and judicatory between China and Russia, pay attention to the development trends and absorb the advantages of Russia side, simultaneously, ponder how to establish and perfect the juvenile judicial system that suits our country situation and has China's characteristics.
