Reform And Reconstruction Of China's Civil Simple Procedure

The phenomenon of "lawsuit blast" is caused by rapid development of world economy, hence civil simple procedure is extensively focused and greatly developed. Civil simple procedure is generally defined as proceeding suitable for hearing the first instance of simple civil case by root people's court and its detached tribunal. Compared with common procedure, civil simple procedure has the characteristics like "more prompt, convenient and lower cost". But at present, the development of civil simple procedure is not so optimistic: legislation is not perfect, judicial practice is relatively messy and theory research in this regard needs to deepen. My article tries to analyze present operation status of civil simple procedure based on corresponding jurisprudence and put forward detailed measures on how to reform and reconstruct the simple procedure. The goal of my paper is to convince that the successful reform and reconstruction of civil simple procedure is key to form a litigation system which can reflect the rules of market economy and also important to collocate claim right of litigant and jurisdiction of courts. And also I sincerely hope that my paper will be helpful to the successful judicial reform in regards of civil simple procedure of our country.
