"Enforcement Difficulty" And The Reform Of The Property Investigation System

One of the main reasons of "enforcement difficulty" is that the property of obligors is difficult to find. Seeing from current circumstance in our country, the problem existed in the aspects of finding out the property of obligors is very outstanding. A flood of case cannot be carried out because the property of obligors cannot be found. The main reason is the law in our country on enforcement procedure of property investigation is crude. Until now, we cannot recognize the importance of property investigation in enforcement procedure, and research on investigating property too less. The related foreign system deserves should be used for reference in our country's legislation.In order to improve the system of property investigation, some advice is given in this article: the obligors must have the liability to declare their property, and. writ of inquiry and other private investigation is required.Finally, I'd like to give some advice about legislation combining the present conditions in our country.
