Its essence is not to fulfill the duties resulting from his traffic accident. The precondition of hit-and-run is that his behaviors constitute a traffic accident crime.According to the article 133 of Criminal Law of the People's Republic of China, there are three states. One is the basic traffic accident crime, the other is aggravating circumstances of the crime, and the third is aggravating result of the crime. So the escaping is not a condition of a traffic accident crime but a aggravating condition of traffic.But according to the legislation realities, the definition of escaping is not nicety, and the motive of escaping is not explicitTherefore, the writer tries to correctly define the escaping, and analyze the motive of escaping after a traffic accident happens.
