Solid waste pollution has already become one of the four major public hazardswith water pollution, air pollution, noise pollution. Not being as ocular as waterpollution, air pollution and noise pollution, solid waste pollution has its owncharacteristics. There is a big consumption of resource and energy in our country,which results in produce of enormous solid waste. In recent years, "Law of preventionand cure of solid waste polluting the environment", "Law of clean productionpromotion" and etc has been regulated successively, but the amount of the solid wastestill increases continuously, and the environmental pollution caused by solid waste isbecoming serious day by day, which leads to great waste of resources at the same time.The first part of this thesis put forward the concept of the solid waste and basicclassification at first, and then analysed the current situation and reason of solid wastepollution of our country, pointing out that the defects in the laws and regulations ofprevention and control of pollution of solid waste existing in our country must bereviewed. The second part of the thesis thought deeply of present laws of preventionand cure of solid waste, holding that there still existed a great deal of parts whichneeded improving, for example, the relation between rights and obligations in solidwaste management stipulates unclearly, the judicial authority can not get involvedsmoothly , the legal norm lacks effectiveness and the legal system of recycletreatment of solid waste is a still blank spot, etc. So, it is necessary to draw lessonsfrom the foreign advanced legal management and means. The third part of the thesisintroduced the basic systems and characteristics of such country's solid wastemanagement as U.S.A., Germany, Japan, etc. separately, and summarized thebeneficial experiences used for reference by our country, and then thought of theimprovement of the legal system of solid waste management of our country in thefourth part, holding that the rights, obligations and responsibility in solid wastemanagement must be defined, on the basis of strengthening state administrativemanagement by law, the effective enforcement of the judicial power of judicialauthority and public right of participation must be ensured, at the same time , thelegal system of recycle treatment of solid waste should be set up, etc. , which can besaid to the beneficial exploration and study to perfection of the legal system of solidwaste management of our country.
