How The Present Public Administration Shall Adapt To The Requirement Of Managing The Administration By Law

The author of this thesis tries to put forward some ideas on improving the presentpublic administration through expounding the difference between the "desired" publicadministration and "practical" administration. The study ways are mainly data (homeand abroad, ancient and present) and comparison (history and reality, theory andpractice).The author firstly discusses the landmark historical significance of puttingforward " rule the country by law and build socialist country with rule of law" in theConstitution, later the author points out that rule the country by law needs managingthe administration by law, and the requirement about public administration for rule bylaw on management concept, government function and applicable laws as well as thegaps between the present public administration and this requirement. Such gapsinclude: little importance attached to procedure, prevalence of patriarchy, lack of theconcept of rights, inequality of rights and lack of belief, the large amount of publicservants and their poor qualities. Finally,the key part of this thesis discusses how thepresent public administration shall adapt to the requirement of managing theadministration by law: firstly, the relationship between the policies and laws, betweenthe rights and the laws shall be handled properly;the "Election Law" and electionsystem shall be improved, the quality for participating and involving political affairsof the congress shall be improved to establish the prestige of the people's congress,the status of the people's congress shall be reset and be guaranteed by system (such asthe "Supervision Law" long been desired), and thus change the selection andmanagement of the officials from the root. The author also holds that the staff in thepublic administration shall enhance their study on knowledge and improve theircapacity ,strengthen their awareness of "procedure" in earnest(the "law ofadministrative procedure" is being formulated). The settlement of the officials fromthe demobilized military cadres must be further handled in a scientific way. Theproportion of the law talent in the public administration shall be increased. In addition,a "Supervision Office" shall be established to prevent the collision between the publicadministration policies and to decrease the " Opportunity cost" in economic life, thenwe can outstand the system efficiency of the socialism, uplift the administration leveland the capacity of exercising power in an all-round way.
