The research on application of law about property relation between husband and wife concerning foreign factor in china is very poor, that was usually looked as the application of law about matrimonial property regimes. But in fact this article is concerned with at least maintenance succession and dismemberment of property between husband and wife. Our country has drew the draft of the civil law code, and prepared one article on this field, but the article was so brief ,and not enough to solve the problems of this kind law case.So we must goes in depth research on this field, find the essence of the problems, and use the basic theory of the international private law, worked out the regulation of the application of law on the marital property relationship, in order to protect the lawful rights and interests of the parties of the law case.
