Research On Some Legal Problems Of Domestic Passenger Carriage On Water

Generally speaking, in the domain of Maritime Law, the scholars pay much more attention to the investigation for the cargo carriage. However, the passenger carriage should also worth our more study, because of the importance of human-being's life. The subject article compares the passenger carriage contract for international passenger carriage on sea, domestic passenger carriage on sea, passenger carriage on fresh water and passenger carriage on other waters. By such comparison we are noted that, although the contracts of passenger carriage are identical, they differentiate with each other. They are identical in the conclusion, taking effect, rescinding, invalidation and the legal status of port operators, but the carriers assume different obligations and liabilities. This article tries to get a conclusion which is more adaptive to the present domestic passenger carriages, by referring to the newest international development, aiming to arrive the balance of passenger and carriers' interest.Meantime, this article also involves the multimodal passenger carriage. Train ferry is a new kind of carriage vehicle in China, so that we seldom do legal research on this point. However, we can acquire a small quantity of legal data related to train ferry. This article discusses some points of train ferry legally, just tries to lead scholars pay more attention to this marginal subject.
