Research On Farm Produces Trademarks Protection

China is a great agriculture country, and the farmers are the majority of the population, but agriculture has always been a weak quality industry in our country. The problems such as lacking of quality and the international competition ability have repressed the development of farm produce trade. Providing perfect protection to farm produce trademark is a valid way to resolve these problems. Farm produce trademarks have great effects in aspects of raising the farm produce quantity and improving our country's agricultural competition abilities. Strengthen the protection to farm produce trademark can improving the production and sale of farm produce, speeding up the development of our country's agriculture, increasing farmer's earning. So study the legal theory of farm produce trademark has great academic and practical meanings. This article will analyze the basic theory of farm produce trademark, study the actuality of the protection about farm produce trademark and design a perfect protection system to farm produce trademark. I wish this article can give some contributions to the legislation and administration in field of farm produce trademark protection.This article can be divided into three parts.In the first part, I will study the basic theory of farm produce trademark, and discuss subjects such as concept, characters and types of it. Farm produce trademarks are marks used in farm produce, they can distinguish one kind of farm produce from others. Farm produce trademark has great relations with geographical indication. Farm produce geographical indication belongs in farm produce trademark and geographical indication, it is the intersection of them. Compared to industrial product trademarks, farm produce trademarks have a lot of characters. They do not have very long history, geographical indications are majority of them, and the owners of them are always not the users of them. Farm produce trademarks can be classified by the trademark owners' types, the trademark's character and the farm produce's types.In the second part, I will mainly study the actuality of farm produce trademark protection. Firstly I will introduce the international actuality of farm produce trademark protection. Then I will mainly discuss the domestic actuality of protection, analyze the meanings of farm produce trademark protection in aspects of promoting the developmentof agriculture, raising the production and sale, improving international competition abilities of farm produces, increasing farmer's earning. I will introduce the legal provisions about the farm produce trademark protection in our country and analyze the characters of the farm produce trademark development in our country, indicate the institution obstacles and consciousness obstacles to farm produce trademark protection.In the third part, I will design a protection system to farm produce trademark, this part is the most important part in the whole article. A proper protection system to farm produce trademark should be supported by the government, agricultural associations and farmers, and perfect trademark legislation is the base of this system. In this system, government's function is making and actualizing policies to strengthen the protection, agricultural associations' responsibility is mainly managing the collective trademarks and certification trademarks, and fanners should take proper strategies in agricultural production and management to protect their trademarks.
