Alien invasive species is one introduced by either intentional or unintentionalhuman activity that might has established populations in natural or semi-naturalecosystem and has caused obvious threat to the biological diversity. Nowadaysinvasion species is the second only to habitat loss as a cause of destroying biodiversity.Alien invasive species has much influence including directly reducing the number ofnative species, threatening human health and development of society. Alien invasivespecies has become a global environmental problem. Our country is suffering serioushurt.Biological invasion has evoked the extensive attention from the all countries,who propose many kinds of solutions especially legal method. The internationalsociety has legislated lots of international law and developed perfect international lawsystem such as permit system, prior informed consent system, inspection andquarantine system, etc. Despites the gaps in the international regulatory frameworkfor alien invasive species, international law has played an important role. Moreoverwe should take the legislative experience of other countries, such as USA, NewZealand and Australia for reference, summarizing regulations about biologicalinvasion in the other country document.In China, law study of alien invasive species is so late that legislation of alieninvasive species are few and scattered, saying nothing of an integrated legal systemand management system. In order to protect biological diversity, human health andsustainable development of society, the complete law system should consist ofenvironmental protection law, the law of preventing and controlling alien invasivespecies and local law. The effective basic principles must be abided by as preventionand precaution principles, permit system, beadroll system, inspection and quarantinesystem, emergency disposal system, beadroll system, economic measures. Besides,legal responsibilities of related party involved in introduction of alien invasive speciesis also an important component of legislation...
