The Study Of The Improvement Of Civil Procuratorial System

Civil procuratorial system is an important part of the civil procedural legal system. The civil procuratorial power meets the requirement of maintaining uniform civil legal system of China, but there are many deficiencies in our civil procuratorial system. How to improve the system is not only a great theoretical problem, but also the problems about legislation and the administration of justice practice waiting to be solved urgently.In this thesis, I analyze the concept of civil procuratorial system and the problems existing in our present civil procuratorial system. And then, the paper explores the basic theoretical principles and legal basis of the system, analyzes the rationality of the system., bring forward some suggestions to solve the existing problems. To perfect the civil procuratorial system, it is necessary to impart the procuratorial organ the right to file the civil action for public interests. Though there is no legislation, the practical departments have made enlightening exploration on this system. In my opinion, this system does good to the protection of state interests, social interests and crucial interests of citizen. The paper is composed of the preface, five chapters and a conclusion. The main content of eachchapter as follows:Chapter one is an overview of the civil procuratorial system. In this chapter, the concept and the extent of the system are discussed. Then the paper discusses the problems and deficiencies existing in current Civil procuratorial system. All the problems discussed in this chapter will be solved in the following chapters.Chapter two is the analysis of the rationality of the civil procuratorial system. The paper explores the basic theoretical principles and legal basis of the system, and analyzes the rationality of the system.In chapter three, I bring forward some suggestions to solve the existing problems in the system of civil protest.In chapter four, I propose to impart the procuratorial organ the right to file the civil action for public interests, since there are so many civil actions concerning public interests. To establish such a system, the paper brings forward legislative proposal.
