During The 20th century the financial liberalization has changed dramatically, and our country also participating this trend involuntarily. After December 11th 2006, China will abolish the limitation to the foreign banks currency operation in terms of field and objective territory; thereto indicate the Country will discharge all the duties before her access to WTO. We will embrace the new finance-opening era. The legislative system concerning supervision of foreign banks is the topic of this thesis; the perfection of related laws and successful realization of the finance open-door has great practical significance.Besides the definition and the supervision of foreign investment banks, the first part of this paper will analyses the necessity of supervision over foreign investment banks from three aspects: economic, legal and the social value, summarize the content of the supervision and draw a conclusion of two different shapes between restrictive supervision and prudential supervision,paving the way for the following discussion.The second part,it will introspect the present legislative supervision system on the basis of problems of foreign investment banks operation in our country. We need to complete our laws because the current restrictive supervision system over foreign investment has been out of date.The third part, it will focus on the constitution of mode of existent legislative supervision over foreign investment banks macroscopically. It will propose the topic at the beginning and put forward the core principal that we should establish a prudential supervision system and realize the unitive supervision of domestic and foreign investment banks gradually.
