The Perfection Of Legal System And The Assumption Of Executive Mechanism For Ecological Compensation

The problems of population, resource and environmental pollution in our country have become increasingly serious. It has influenced the economy development of our country. It is an important aspect to set up ecological compensation system for the sustainable development of economy, environment and resource protection. Ecological compensation provides compensation on the fund, technology, material object and the favorable policy for the residents who lose chance of development because of environmental protection. It also includes the expenditure on scientific research and educational expense in order to promote environmental protection consciousness and improve the environmental protection level. Ecological compensation system is the combining of ecological, economy and law. This thesis explores the conception and theoretical base of ecological compensation from the theoretical point, and describes practice and development at home and abroad from the historical view, and analyses the main question in our country at the present stage from the practical point. The design mode of ecological compensation system is emphasized in this paper. Law is the base of the ecological compensation system being effective carried out. The assumption to perfect legal system of ecological compensation has been put forward according to the fair idea, the combining principle of government and market compensation, the integration principle of economy development and ecology construction. The assumption includes establishing property right of environment and resource, price system of environment resource, ecological tax and green gross domestic product (GDP) system. The execution mechanism of ecological compensation has been conceived: western ecological compensation, important ecological functional region compensation, intersectional drainage area compensation and opportunity compensation. The corresponding system consists of legal system, financial system, public participant system, scientific and technological assistant system. Theinnovation of this thesis is composed of reasonable design of the mechanism of the ecological benefit investment and the behalf insurance. The concept of opportunity compensation brought forward is another innovative point.
