General Research On Law Agency System And Development Of Foreign Trade Agency System In China

Agency, one of the most prevalent legal forms in current international economic communication, has been widely used not only in national area but also in international area; No matter which kind of law system, continental or Anglo-Ameriacn both classify it as an important legal system into the civil and commercial system. Foreign trade agency is one form of such agency. It's application and adjustment must follow common rules of agency system.Three aspects about agency are analyzed and discussed in this paper. Firstly, introduction of three problems according to the foundation of agency. One is initialization, development and infection of agency system. The other is agency and agency right. The last is right and obligation of both parties under agency contract.Secondly, comparision between the continental law system and Anglo-American law system. The comarision are including theory foundation, types of agency, beginning and ending reason of agency relationship and also law result of agency action.The newly modified FOREIGN TRADE LAW OF THE PEOPLE'S REPUBLIC OF CHINA has been put into practice. Under such background, we here is discussing current status and problem of foreign trade agency first. And then give some own opinion that special agency should not be existence in future development of foreign trade agency. Some new suggestions are also supplied as details.
