On Right Of Privacy

The research and legislation on theory of privacy right appears late in our country,In recent years ,with the infringement upon privacy and people's close care and importance study on it and have been working for the legislation on this right. As an independent personal right,the right of privacy has been written into the Draft of Civil Code. Moreover,Act on Protection of Personal Information is in brewing and drafting. However,the right of privacy,being existing different realization,has a long way to experience in theory and practice. The protection system of right of privacy has not been perfect, there are some traditional issues that has not been solved,such as the right of privacy and the right to know. The constriction of news report ,with the widespread use of electronic products and rapid development of network message technology,we have to confront new issues as follows: how to solve the legal problems brought by the influence of information technology on private life ? how to protect employee's privacy at workplace?How to protect privacy in public area? etc. From the world wide,legal protection for privacy shouldn't be overestimated. It is an extreme common phenomenon that the legislation on privacy is defective and judicial practice on privacy is stagnant.In the field of infringing personal privacy,the government and its bodies frequently play the role of infringer,which shows that we should strengthen legislation and judicial protection for privacy. Based on the precedent's study,the author made an elementary study on some basic theory issues,such as the concept,property,characteristics and content of privacy. The development of network technology causes news issues in the legislation of protecting right of privacy ,while it has not been shown in relevant laws. Meanwhile,the author tries to discuss the protection of privacy and the conflict and balance of privacy. Finally, the author points out the defects in our country's legislation and puts forward some immature considerations on perfection of the right of privacy.
