On Civil Litigation Invalidity Problem

Civil litigation invalidity problem has neither been involved in our country's civil procedure law. Nor been researched theoretically sufficiently. Especially form a systematic point of view .On the basis of the fundamental structure of civil procedure ,the flowing thought can be formed. So it can be concluded that the civil litigation problem should be researched.We know that the most fundamental elements of civil procedure are litigant and adjudgement. The civil litigation rights of the litigant play an important role in the process of litigation. So right to civil litigation paying close attention to by people. However,how the litigants deal with their litigation rights depends on their psychic attitude. Some exert their litigation rights properly and timely;some lost their litigation rights because they don't know the existence of their rights at all;and the other try to block the process the litigation intentionally and improperly.How to reserve this phenomenon in our civil procedure.I think that it is perhaps a kind of effective choice to introduce the regulation of civil litigation invalidity.In essence,the litigants exert right or not,even the different way the exert the rights make essentially effect to,and in a certain point of view,decide the result of the litigation.As an important problem of civil procedure,civil litigation invalidity problem has abundant content,it is not an independent problem.So we should be understand and research as an institution of civil procedure law.This article includes three parts of foreword,text and postscript.the text part is divided four chapters mainly.In this four chapters,the author discusses the concept,the reasons of being,the significance and values of the civil litigation invalidity problem.And in the main part of this article,the author dissertate the idiographic type of the civil litigation invalidity problem in detaiLAt the end of the article,the author renders his own opinions on how to reach the regulation civil litigation invalidity of our civil procedure law.
