On The Influences Of The Protection System Of The Intellectual Property Right On Technological Innovations

As an internationally current and most effective legal institution to maintain human privilege and promote technological innovation, the core of the protection system of the intellectual property right is that a country protects monopolization of the owners of intellectual property right during a period of time to encourage intelligent creative activities according to the law. Rooted in market economy and characterized by the clear definition and effective protection of intellectual property right, the protection system offers a kind of inherent motive mechanism and an external fair competitive environment for technological innovation, and hence it is valued by the countries all over the world . Due to high investment, uncertainty and high risk of the technological innovations, this dissertation expounds the permeability of intellectual property right in the course of technological innovations. Namely, Intellectual property is contained at every stage of technological innovations:at assumption and estimation stage; at the R&D stage; at the experiment and test production stage; at the production and selling stage. And what's more, it makes an analysis of how to adopt suitable means to protect intellectual property right for technological innovations composed of three basic types : independent innovation , imported innovative , cooperative innovation. The dissertation explains culture, as an unofficial system, will influence and restrict the formulation and implementation of such formal institutions as general and specific policies in countries with the theory of new institution economics. In contrast with U.S.A., Germany, Switzerland and, Japan, China's intellectual property right starts late and relatively backward. As one unofficial system, traditional culture affects and limits the development of China's institution of the intellectual property right as well for its negative functions. Finally this dissertation gives an empirical analysis and puts forward relative countermeasures and reasonable suggestions to the existing problems in strengthening intellectual property protection and promoting the technological innovations in our country.
