Discussion On Fine

First of all. this thesis elaborats the evolution of fine and its development in China after the foundation of the Peoples Republic of China, introduces the survey of the system of fine, makes clear the legal nature , features and classification of the system of fine, discusses the significance of the system of fine and rationality of its existence, analyzes its position in the system of punishments of our country. Secondly, applying positive analysis of statistics, beginning from the situation of sentence and execution of fine involving criminal cases heard by certain intermediate court and basic-level courts of railway transportation in recent two years, this thesis comments generally on the current situation of application of the system of fine, reveals many problems of this system found in judicial practice, the difficulties of execution of fine especially, analyzes reasons for these problems from judicial conception, legislation and current situation of judicature. Then, from the point of view of protecting rights and interests of litigants, guided by advanced philosophical theory of punishment, also basing on my judicial practice, this thesis makes some constructive suggestions to perfect the system of fine.
