With the application of EDI in modern business, the trend for dematerialization ofbills of lading is inexorable. Since Electronic bills of lading can solve the problemsencountered with traditional bills of lading, and it is safer, more efficient, faster thanthe traditional bills of lading, it begins to gain people's recognition. However, atpresent, electronic bills of lading is at its early stage, due to little application, littleavailability of international and domestic legislation, and significant differences inlegal nature and legislative model of electronic bills of lading between internationaland domestic legislation, the legal status of electronic bills of lading is far beyondestablishment. Given the fact that Legislation of electronic bills of lading in China isalso in initial stage, how to establish the legal status of Electronic bills of lading withlaw, standardize the application of Electronic bills of lading in our country is ourpriority. Regulations relevant to the legal validity, transfer mechanism, nature ofelectronic bills of lading in the legislation of international organizations and othercountries, and their selection of legislation model will provide high implications forthe legislation in China.
