Research On Protection Of Rights And Interests Of The Police

Currently, both experts in Law and the mass multi media just ignore a topic: the safeguard of the human rights of a special lawsuit body-the police, while they are reforming the criminal law and in their study on the safeguard of the criminals judicial rights.In recent years, the police being attacked by violence or non-violence has been emerging endlessly. Policemen's human rights of health, dignity- are always challenged and the rights to have a refreshment and maintain healthy are always interfered. The glories of being the nation's legal force and machine can no longer retain the effect of protecting the policemen and the policemen are emerging into a inferior body.In a society where law is highly advocated, policeman is also a citizen and should enjoy the justice and equality that the civilization of law has brought about. It's the moral as well as the legal responsibility to guarantee the police's basic rights while they are executing their duty to protect the mass. For one side, from the point that a policeman is a citizen we can conclude that the policeman is equal to an ordinary citizen and the human rights of the police is a general concept; on the other side, police being the legal force to protect the benefit of the mass, their rights to fulfill their task being protected by law should be a special concept. In the paper, I take the full use of a combination of theory and reality. Starting from the definition of the human rights of the policemen, I compare it with some other related definitions and then the characteristics and the main contents of the human rights of policemen were illustrated. And also, I cite the related laws and experiences in protecting policeman's human rights of some other countries and explore the current conditions of China's policeman's human rights the reasons thereby. On this basis, I give some suggestions on the possible solutions to improve China's policeman's human rights from four aspects: Construction of Law System, Methods of remedy, Policemen being fully-equipped on duty, Executive environment.
