| The environmental liability of the local government is to undertakethe liability when the local government and its employees don'tperform duties or perform duties correctly. The paper comes to aconclusion that the local governments have environmental duties andshould undertake the relevant liabilities. But the present law didn't orderclearly. It made the government can't perform duties very well in practice.So the environmental liability of the local government must beinstitutionalized. The paper wants to make a research about these to findthe way to solve these problems.This paper is divided into four parts. The main contents of thispaper are:Introduction : The cause of the study on the environmental liabilityof the local government.The first part : Construction of the basis of the theory. This part isthe general introduction of the local government and the relationshipamong the local government and central government and the departments.Then we confer the connotation for the characteristic and the form ofinstitutionalization on the basis of these theories .The second part : This part put emphasis on the premise of theenvironmental liability of the local government and summarize thecontent of the liabilities the local government should take.The third part : Analyse of condition of our country. The powerbeing disconnected with liability is the obstacle in the proceedings ofinstitutionalization . The cause is not only for the system but also for theimperfection of the present law.The fourth part : The way to solve problems. Firstly, we shouldlegislate the duties of local government . Secondly, we should makeorders about the system of liability scientificly .Finally, we shouldestablish the effective supervising system , including country supervisingand society supervising . The object we want to realize is to let theliability of the local government institutionalized.Conclusion : The expectance from the legal system to rule by law.
