The System Of The Punishment Suggestion Power Research

The standards of the punishment suggestion power are deviated in the whole world widespreadly. The power plays on important role in the criminal procedure .So studying it is getting inevitable. At present, to construct the power in the Procuratorial reform in The People's Republic of China are necessary. This dissertation is divided into four parts such as:Chapter â… : After analysing the necessity and foundation, definiting among the concept of the punishment , the punishment suggestion power and the concept of its system are discussed.Chapter â…¡:Valuable analysis. Clarifing both the value of philosophy and the meaning of litigation value , then studying between the property of the public prosecution power and the punishment suggestion power. In my opinion, to construct the system of the punishment suggestion power, the fairnesss is chosen firstly, efficiency and human right protection secondly.Chapter â…¢:Abroad relevant legislations and practice introduction. Conclude mainly the characteristics and inspiration from them.Chapter â…£: Criminal procedural infrastruture. Combining civil pratice, pointing out its weakness. The paper puts forward concrete construction . The writer expects the power that will influence legislations and judicature positively in our country.
