Analysis On Causes Of Medical Dispute And Intervetion Study

High tech and high risk of medical service determine the ineluctability of medical dispute. Relationship of doctors and suffers has been pushed forward on the stage while medical dispute is being fouced as a social hotpoint. April 4th , 2002, regulations of common pleas evidences was established and the responsibility of quoting evidence converted. After September 1st, 2002, rules to deal with medical malpractice was published, medical dispute greatly increased and the action pattern of medical dispute changed. There are many researches on the cause, priciples of keeping away and dealing with medical dispute, while the systematic analysis on the course of the medical dispute is absent;researches of this field are mostly seperately and derterminate, while quantitative and experimental ones are limited;there has been no resarch on factors leading to typical medical dispute and their occurrence, development, change, formation and transformation. Medical institutions have not set up the complete system of supervision, control and intervention of medical dispute yet. While dealing with medical disputes, the measures are randomized and blindfold lacking of pertinency and systematization.Refering to the theories of crisis management and the principles of medical safety, this research focused on the current status of medical dispute in the state and brought forward policy advices of keeping away from medical dispute from the aspects of macro-level;based on the clinic investigation and intervention, analyse the leading factors, causes, course of occurrence, development, change and formation, transformation tendency, transformation results and mutual relationships of factors by the means of case study of medical dispute from 5 hospitals. This research reveals the forming rules of medical dispute and built up the invention system. From the causes and formation of medical disputes, stage theory of medical dispute was established together with the intervention and interdiction charging of medical disputes from the view of micro-level.By the literature review of last 5 years of CBM database with the keywords of medical dispute, medical accident, medical malpractice, medical disfigurement, analyse the current status of medical dispute research. Analyse the cogniztion of medical dispute by local randomization in 5 hospitals from January 2003 toDecember 2003. Investigate case history data of medical dispute and corresponding transaction docs of management department of 5 hospitals from January 2000 to December 2003. Define medical disputes from January 2000 to December 2002 as the comparison group without systemetic invention, and define medical disputes from January 2003 to December 2003 as the experiment group with systemetic invention.Works are carried out below of this study: first, micro-level research on the forming rules of the medical dispute;secondly, research on the negative influence of medical dispute, range, proportion, extent, rank, etc. to certify the importance of prevention and intervention;thirdly, feasibility research on intervention to medical dispute;fourth, research on the best opportunity of intervention and supervision of medical dispute. Provide new thoughts and solutions of prevention and intervention to the medical dispute and establish intervention system of medical dispute based on the study.Through investigation, positive works could have been terminated 71.66% of the medical dispute in the mind of medical faculty while 57.20% of the medical dispute could have been terminated in the mind of the ill, which provide the external basis of intervention. According to the action characters of the ill in, medical disputes can be devided into four periods, latent period, unveil period, break out period, deferment period. Systemetic and pertinent measures of each period will improve the successful rate of intervention. Data from 5 hospitals shows that intervention or not, early or late, results differ a lot (P=0.002<0.05). The timing of intervention has an obvious infect on the successful rate of intervention. The more the amount of medical faculty enlarges, the more time will be taken. The best opportunity to interdict medical dispute is the latent period.This study revealed the development rules of medical dispute, brought up the concept of staging, established the intervention system, and ensured the best intervention timing and method.
