Crime of Engaging in Self-seeking Misconduct is set against Judicial personnel, but it is not clear in theory of criminology and practice who would be the right person prosecuted, whether Juror could commit said Crime, how to set up the standard of complicity. This ambiguous definition of Crime subject makes practice confused. Controversy in academe is only aimed at provisions in Criminal Law and never touches the theory behind said crime, there is still not a clear understanding of said Crime. In order to touch core matter of Crime, this paper is looking for settlement of problem of subject matter of Crime on the base of subjectivism and objectivism. Subjectivism and objectivism are two main schools of modern criminology, and the roots behind many problems of criminology. It would be of great help and broaden theoretical eyesight if subjectivism and objectivism are used.Thus, this paper is beginning at the point of objectivism and discusses every detail related to the subject of Crime with comparison with Objectivism that gives a different answer.
