Investigation On Some Issues Of Criminal Lawsuits Of Infringement Commercial Secret

Since current criminal activities of infringement commercial secret have shown some new characteristics, it is necessary to adjust the legal procedures of infringement commercial secret case of the Chinese criminal procedural law. In this paper the characteristics, problems and origins of the criminal lawsuits of infringement commercial secret in China were analyzed, and its legislation and judicature of the United States, Japan, Canada, and Taiwan were compared. Hence, the strategies to improve the lawsuit of infringement commercial secret case were proposed. In the meantime, the transformation of lawsuit idea, the methods to improve the determination of lawsuit assistant and litigant, lawsuit jurisdiction, judicature appraises and trial method in the procedural nature legislates were also proposed. Finally, the lawsuit proves of criminal activities of infringement commercial secret were investigated. All these results would be meaningful for improving the legal procedure of the criminal lawsuit of infringement commercial secret in China.
