Abstract/Summary:
As a kind of social phenomenon, Rotating Saving and CreditAssociation (hereinafter referred to as ROSCA) has brought us serious harm, howeverfew people has carried out thorough and comprehensive study on it. In order toenhance common people's emphasis on ROSCA, based on a complete introduction toROSCA, the author tries to analyze the participants' subjective and objective behaviorin the ROSCA as well as their potential responsibility, especially criminalresponsibility they may bear. This thesis adopts analytical, comparative and historicalmethods. It starts with illustrating the operative regulations and characteristics ofROSCA and combines with the specific applications of Criminal Law. Throughdetailed analysis on its causes, its functions, its influences on the social economy andits development, the author comes to the conclusions as follows: (a) ROSCA has itsown historical and realistic bases and it won't perish in short term; (b) From the socialeconomic point of view, except serious negative effects ROSCA also has somepositive effects; (c) The participants of ROSCA shall assume civil responsibility,administrative responsibility and criminal responsibility accordingly; (d) As for thecriminal responsibility, the participants of ROSCA may involve in illegally taking indeposits from the general public or raising funds by fraud; (e) The disposition ofROSCA is a systemic project, and calls for long-term cooperation from relevantgovernmental departments.
