This thesis makes a few tentative explorations in these respects of constituted requisites, subjects,ways and reasons for counterplea of liability for news tort.News tort lies in the sensitive connection between the civil law and the constitution. There is a crash between news liberty and human dignity behind the phenomenon of news tort; therefore, it is worth of theoretical research. News lawsuits increase quickly in recent years. On the one hand, it reveals the enhancement of lawful conception of citizens; on the other hand, it reveals the improvement of social democratization and legislation. Because news tort attracts more attention, the research of news tort law is a hot topic in tort act law, so articles, works and symposiums increase more and more. From published articles about news tort, participants in news circle pay more attention to supervision and priority of liberty value of news but others to importance of protecting legal rights of citizens and legal person. On the whole, the research in tort act law is in beginning and there are so many problems in the stage of imploration and discussion. Therefore, that brings about certain difficulty to authorities so as to use different value standard in different courts, which is disadvantageous to seriousness of law and to active function of news medium just as for question about compensation for spiritual harm.I think, news is a report action concerning late occurring incidents by means of public spread mediums such as newspapers, magazines, news agencies, broadcasts and televisions.
