It's been 20 years since China reestablished the labor dispute arbitration system in the 1980s. As the reform in market economy goes on, defects in the arbitration system emerge. Like any other systems in the world, it takes time and practice to create and gradually make perfect the labor dispute arbitration system. As the call for improvement in the systems grows, people believe the time has come. In this paper, the author makes his proposal on reconstructing the system by giving a reflection on China's current labor dispute arbitration system and elaborating the same systems in developed countries.In China, the labor dispute arbitration system began with the Regulations on Labor Disputes issued by the government of Republic of China in June 1928. The Labor Law of Chinese Soviet Republic issued by the Chinese Communist Party in 1931 gave detail regulations on handling labor disputes and the law became foundation of the law system on labor disputes after the founding of People's Republic of China.The development of new China's labor dispute arbitration system can be divided into four phases: the beginning period from October 1949 to 1956; the suspending period from 1956 to 1986; the reestablishing period from 1987 to 1993 and the developing period from August 1993 until now.A milestone in China's labor dispute arbitration system is the issue of Regulations of the People's Republic of China on Enterprise Law Disputes by the State Council on July 6, 1993. A series of regulations drafted by the former Ministry of Labor, including Regulations on the Organizing of Labor Dispute Arbitration Committee, Regulations on the Function of Labor Dispute Arbitration Committee and Regulations on the Organizing and Function of Enterprise Labor Dispute Arbitration Committee, followed.
