On Punitive Damages

Punitive Damages is used widely in the common law countries, along with the development of the social economy and amalgamation of the two families of law, the civil law countries put up passion on Punitive Damages. Our country introduced Punitive Damages in People's Republic of China Consumer Rights Protection Law in 1993.This essay, including three problems of Punitive Damages, is such as the conception, the reason, the integrants and the applicable realm. The first part mainly concerns the problem what Punitive Damages is, including the histroy, the concept, the characteristic and the property. The second part mainly answers the question why Punitive Damages can exist independently, namely analyzing its rationality from the value and the function. The three part mainly settles the problem how Punitive Damages should be applied, namely construct Punitive Damages on the grounds of practical situation.
