Research On Legal System Of Ownership Reservation

The legal system of ownership reservation of our country is not perfect, which can not meet the demand of socialist market economy. Perfecting our country's legal system of ownership reservation has become inevitable. This thesis analyses some main aspects of legal system of reservation and gives some advice to perfecting the legal system of ownership reservation .This thesis consists of four chapters .The first chapter introduces the concept, characteristics and types of ownership reservation. The second chapter considers that ownership reservation has some merits the other security ways have not .The third chapter is important in this thesis. It analyses the construction of ownership reservation, considering its object include real estate movable and property. From the publicity system of the ownership reservation, whether its object belongs to real estate or important movable property, the publicity way should be the registration oppose. Expecting right is creditor's right, but it contains nature of real right. The getting back right is a security way for creditor's right. And this chapter analyses the legal relationship between the betray people and buyer, the legal relationship between ownership reservation and other rights. The forth chapter give some advice to perfecting our country's legal system of ownership reservation.
