Russia is the biggest neighboring country of China. It is closely knotted with China in aspects such as in politics and economy. Although both the evolutionary path and goal patterns of China and Russia are entirely different, the two countries share the same ideology and the social system, specially the judicial system of the former Soviet Union had influenced that of our country of quite a long time. Basing on learning and referencing Soviet death penalty system, the Chinese penalty system established . In recent years, Russia is devoting positively to joining to European Union organize, and maintain consistently with European Union on the death penalty and policy, so Russia has carried on the comprehensive reform to our country death penalty system. Today, China and Russia will jointly face one important problems which are giant differences between China and Russia, conflicts of extradition and eliminating cooperation bulwark between China and Russia. Furthermore, studies the Chinese and Russian death penalty system, the author found that this significant model would be very meaningful to the judicial cooperation and exchange among china and other five central Asia countries. This article adopts the comparison method, by reviewing the China and Russia death penalty history, discussing the difference between China and Russia present death penalty system, and seeking the effective way for mutual judicature assistance in international criminal between two countries.
