The WTO Judicial Review

As one of the important contents of the WTO agreements, the judicial review system has laid down some rules for each member country to draw up their own system based on the requirements of WTO judicial review. Therefore those agreements reached by the WTO members can be fairly and reasonably in a unified form in each member country. Whenever anyone of the member's administrative act is infringed on, the necessary relieves would be supplied. The development of the international trading would be promoted in a free and high-effective way. Thus, the people's living standard would be improved.This text from analyzing the theories origin of the judicial review of WTO to start, passing to investigate the judicial review of WTO the formation process of the system, analyzed the structure and main characteristics, functions of judicial review. Then this article discusses the system of judicial review in China law and the commitments of China at the accession of WTO. Furthermore discuss the necessity and possibilities the judicial review brings into the economic law field.. At last the author provides some suggestions when considering the relation between judicial review and the DSU of WTO and the concept of judicial review. Under the background of having been a member of WTO, we should establish our own judicial review system as soon as possible. We need to adopt the methods of establishing and perfecting the judicial review basis; continuously expanding the judicial review scope; reforming the judicial view standard and strengthening the professionalism of trial group.
