Electronic Payment means someone putting out their payment order directly or indirectly through the Electronic Ending for money paying and funds transferring. Electronic payment makes enormous influence on financial services and electronic commerce. Also it puts forwards to a series of inevitable questions and challenges which cannot be evaded on the financial institutions and the supervisor departments which provide the electronic payment services. The reality nowadays is that, the legislation of electronic payment is seriously lagged behind, and effectiveness levels are not high enough. The legal situation is not unanimous with the developing levels of technology. The risks under electronic payment could not be controlled effectively. Compared with international relevant legislation, the article explores many related problems, which appear on the procedures of electronic payment, such as how to keep security among many legal relationships, how to balance the conflict between the two different pursuits of values- security and efficiency, and how to establish an appropriate regulatory order and legal norms. Our aims are to perfect the legislation by avoiding the electronic payment risks, to clear legal obstacles, and to establish our electronic payment supervision system to protect payment from insecurity.Other than the preface and the epilogue, the scheme of the discussion is divided into four chapters as follows:In chapter I, the author intended to describe the specific performance of electronic payment risks. Firstly focus on the exposition of electronic payment's definitions, characteristics, and classification. Meanwhile, to avoid the risk of electronic payment, the author makes a comprehensive analysis on legal regulation definitions, and then comes to the conclusion that legal regulation has a great positive significance on the guarantee of the security of electronic payment.
