The Legal Supervision Of The Risks Of Securities Company

The securities company, the most important interemediate institution in the capital market, is the bridge between fund-raisers and investors. Its criteria of conduct and condition of risk are important to the steady and prosperous running of capital market. The securities companies of our country, which usually get out of line when running the business, have generated huge management risk and bad property in the downturn. And these risks show social, long-term, complicated and systemic characteristics. In order to protect the investors' benefits, guarantee the transparency of the market, reduce the systemic risk, the legal supervision over the securities companies'risks has become the important work of the supervision insitution.The paper includes three chapers. In the first chapter, it elaborates the necessity and feasibility of the legal supervision over the securities companyies' risks from the positive and normative studies. It analyzes the main risks in the securities company of our country and points out the urgent demand that our supervision insitution should strengthen the legal supervision of the securities companies' risks by positive study. It also discuses the economic and legal theorical foundations of the legal supervision of the securities companies' risks by normative study. In the second chapter, it analyzes the legal supervision institution of the securities companies' risks from there aspects, including the supervision conception, the supervision modle and the supervision content, on the basis of the domestic and international practices and the institutional arrangement. On the basis of analyzing the domestic supervision system and comparing it with overseas measures, it points out the limitation of our supervision system.
