The Legal Conflict And Harmonization Between GATT/WTO Rules And Environmental Trade Measures

Under the development of economic globalization and the tide of environmental protection, trade and environment has been the hottest topic in the multilateral trade framework and the global environmental protection areas, and the conflict between GATT/WTO rules and environment trade measures is the main embodiment of the issue. As a member of WTO, China has also been bothering by the issue. Therefore, it would be valuable both in theory and in practice for the perfection of WTO system and for the devolvement of trade and environment in China to research the harmonization of GATT/WTO rules and the environment trade measures.From the angle of international law, this thesis analyzes the origins of trade and environment issue in GATT/WTO legal system, discusses the conflict between GATT/WTO rules and environment trade measures by case studies, evaluates the proposals submitted by members to CTE by comparative study, and finally points out the countermeasures China should take in regard to its status quo in trade and environment. Meanwhile, analyzing the outlook of the issue in Doha Round is one of the novel viewpoints of the thesis.The body of this thesis is divided into four chapters. Chapter One discusses the relationship between trade and environment, which is the theoretical background of the conflict. Firstly, the chapter analyzes the origins of trade and environment conflict and the cause of the issue, and then describes the mutual influences of trade and environment on each other. Thirdly, the chapter expounds the conflict between trade and environment and the essence of the issue, and points out trade and environment share the same goal: sustainable development.
