Study On The Trademark Right Infringement On Internet

The coming of Internet Era has weakened the territoriality of trademark right, leading the extension of trademark right and the birth of some new rights as domain name and causing a series of new infringement forms of trademarks, such as cyber squatting, trademark infringement by link and Meta-tag infringement. This paper aims at the study and analysis of trademark infringement on Internet. It has three chapters altogether.Chapter one reviews the historical development of trademark right and introduces the new changes of trademark right on the Internet and its characteristics. Trademark right has rigid territoriality while the Internet is international, open and free. Thus once the trademark is used on Internet, it is easily embezzled of abused due to the speedy transmission.Chapter two introduces the three forms of infringement on Internet. They are infringement on websites, by domain name and hyperlink.Chapter three discusses the legal protection and the suggestions on legislation, law-execution and judicature.
