The waste household appliance(WHA) involves the discarded house electrical and electronic appliances and the old ones. Discarded household electrical and electronic appliance refers to the household appliances that have lost their functions or that can not meet the security standards and function standards for old household electrical and electronic appliance even after repair. Whereas old household electrical and electronic appliance refers to the household appliances that have been previously used but still meet the security standards and function standards for old household electrical and electronic appliance, and can be sold or used as secondhand appliances. Since 1980s, China's industry of household appliance has witnessed a fast development of consumption and production. Presently, China's household appliance renewal has reached its peak period. The recovery and disposal of WHA concerns the environment protection, resources conservation, social sustainable development and integration with global market. However, it's common in our country that many household appliances are used irrespective of their validity time, and WHAs are discarded randomly. The current legislation concerning the recovery and disposal of WHAs has not met the need in this respect.According to the actuality of absence of the legal system of China's recovery and disposal of WHA, the author consulting the common theory of legislative science, the relating legislations of resources and environment, and existing across-country research fruits in this field, emphatically explored the legislative principles and the concrete regulating systems, to contribute to the legislation of this field.After the research of the social actuality of China's WHA recovery and disposal, and the historical retrospect of China's legislating practices on the recovery and disposal of the solid waste, the author concludes that it's the establishment of resource recycle system, environment protection, the management of secondhand market, the protection of consumer rights, the acceleration of the development and competition of China's household appliance industry that entails special legislation of the recovery and disposal of WHA. By consulting the legislation on the recovery and disposal of WHA of some developed countries, and the reform of the legislation principle for environmental pollution control thereof, and combining with the actuality of our country, the author draws the following conclusions.
