Studies On Guarantee Of The Human Rights Of The Accused

In criminal procedure, the accused are in a disadvantageous position and their human rights are easily to be invaded by judicial body. In world widely, protecting the human rights of the criminal accused effectively has become one of the major standards for weighing the civilization and democracy in judicial action in a country. As the concept of human rights becomes popularized in China, the government is paying more and more attention on the protection of human rights and has made some achievement in criminal proceedings. However, invading the accused's human rights are still existing in criminal proceedings. Therefore, it is of great practical importance to study the question of guarantee the accused's human rights in China. Based on the actual situation of guarantee the accused's human rights in China, this paper attempts to make suggestions on perfecting China's system of guarantee the accused's human rights after analyzing the theory and mechanism of guarantee the 's human rights in China and abroad.This paper contains four chapters.
