Research On Act Preservation

The system of preservation is designed to maintain the execution of judgments and orders and to protect the lawful rights and interests of the parties in time. Take the object which preserved as the standard, the system may be divided into property preservation and act preservation. In fact, in many countries and regions, the entire civil preservation system consists of property preservation and act preservation. But the act preservation does not have its history and status in our country. When the scholars discussed the revision of the civil procedure law, they mostly agreed to the proposal that we should set up act preservation in the new code. However, they mentioned little about how to. So by reference to the civil preservation system of foreign countries and Tai-wan regions of our country, the writer wants to make this thesis extend from the current scattered regulations in the maritime procedure law, patent law,trademark law and copyright law, further into the field of ordinary civil action, and bring act into the scope of the preservation, and then establish a system for act preservation of civil litigation in our country, to form a dual systemic frame that lay equal stress on property preservation and act preservation.
