The coming of digital era brings about the ever more severe conflicts of intellectual property in the field of information resource, and the most serious part lies in the monopoly of intellectual property and the public interest, in other words, the conflicting situation between the property possessors such as the authors or the publishers, and readers, libraries, universities and scientific research institutions. The new copyright law broadens the range of issues that should be protected and increases the number of rights that were not included in the old law such as the copyright and circulation. However, the confines of the legal range of information use is too restricted, which is not favorable for the development of public interests . How to deal with such a situation? This paper proposes that drawing on the theory of technique, management and information, the copyright system should be perfected. The legal utilization regulations in the system should be analyzed carefully, and more space should be given to libraries as to the fair use of information under the governing of strict rules to harmonize the utilization and restriction. Libraries should appeal for the help of collective management organizations and various permission models to tackle the copyright problems in the construction process, and should draw on the rules of public lending right in foreign countries to struggle for more space for the construction of digital libraries.
