The Study On Legal Effects Of Electronic Signature

Scientific development brings the birth of electronic commerce. While whether an electronic business is feasible or not is mainly decided by People's confidence on electronic signature. For the sake of securing electronic business and removing relative legal-barriers, legislations of electronic signature in different countries usually entitle qualified electronic signature with the same legal effects as traditional handwriting signature. To discuss the legal effects of electronic signature sufficiently, in this dissertation,four relative aspects will be studied in details.The first chapter is the summary about the legal problem in electronic signature. It discusses the concept and varieties of the electronic signature, also it analyzes the scope to which the electronic signature applies.The second chapter put emphasis on discussing the legal effects of the electronic signature. It is divided into two parts to analyze the problem: first part is about some principles which grant the legal effects to electronic signature, and three legislation modes about legal effects of the electronic signature; Then it introduces the specific representation under the eclectic mode.The third chapter discusses the indemnification on legal effects of the electronic signature. Its principal is discussing the organized ensurement indemnification on legal effects of the electronic signature, namely the electronic certification. After a simple introduction about the electronic certification, then there is an elaboration on how the core certificate authority of the electronic certification is performing.The four chapter is mainly about the introspection to the system of electronic signature effects. Firstly it analyzes the present situation of the system in China, then it talks about the relevant regulations about electronic signature effects in Electronic Signature Law.
