On The Right To Education Of The Children Of Flowing Labor And Its Guarantee Mechanism

Since the inception of reform and opening-up, our country is gradually changing from the traditional society to the modern society; in particular recently, it is in the process of transformation at high speed. As commercialization and urbanization are speeding up and the market requires the reasonable distribution of labor force, the flow of labor is appearing on a large scale. In the flow of labor, there are a group who can't be neglected; they are the children who reach the age of compulsory education moving with their parents. The flow of labor arising from the social changes will touch on the economical, demographic, social and administrative as well as educational fields. The education of these people's children becomes the concern of scholars in the educational circle.The right to education of flowing people's children, whether a theoretical or a practical issue, requires us to have a systematical research.The paper uses related laws and regulations, investigation achievements and some related cases as the major research materials on the basis of absorbing the present achievements and makes a research on the education right of the children of flowing people from the perspectives of the law, education and sociology.The paper mainly discusses the education right of these children from the view of rights and is made up of three parts. Part one: the summary of the education right of the children of theflow of labor. It reviews and analyses the education right of these children legally and discusses the definition, characteristics properties and content of the education right of these children.Part two: the realization and the deficiency of the right to education of the flowing labor's children. It explains the general theories on right realization and deficiency with the legal principles; it also analyses the destruction of the right to education of these children of the flowing people in China and the reasons in details.
