Negotiable instruments are playing a big role in modern market economic. Signature on the instruments that creates the liability is the key of negotiable instruments to strengthen its economic functions. The law of China on negotiable instruments sets strict rules on the signature of the negotiable instruments for the consideration of the safety of the transaction and of the stability of the market order. However, after the implement of the law, some specific rules and juridical interpretation were made as well, which just adds conflict and destroys the structure of the law. From the legal perspective this dissertation refers to the legislations, legal theories and practice on negotiable instruments of other countries, by trying to make some references to legislation on negotiable instruments and development of negotiable instruments'market of ChinaThe dissertation has five chapters. Chapter One and Two of this paper identifies the significance, form and classification of signature. Chapter Three illustrates the effects of signature and limited factors of the effects. Chapter Four discusses the relationship between signature and liability on negotiable instruments. Finally the last Chapter is based on comparing and researching the legislation and legal theories of China and other countries, and gives suggestions on how to build more perfect the laws and regulations on negotiable instruments of China, ensuring the proper solution of the conflicts on negotiable instruments and promoting the healthy development of socialism market economy.
