On The Citizen's Fundamental Rights And Guarantee Under The State Of Emergency

The problem of the state of emergency has got more and more people concern with the perfection of the country' s legal system and martial law be put into the state of emergency in the amendment of the 29th article of the constitution. The citizen' s fundamental rights and guarantee under the state of emergency has become one of the most emergent problems to be solved. The paper has proposed the assumption of the perfection of the citizen' s fundamental rights and guarantee under the state of emergency through the understanding of the concept of the state of emergency, the discussion of the change of citizen' s fundamental rights, the analysis of the present condition of the citizen' s fundamental rights and guarantee and the use of related stipulation of international convention and the constitution of other countries under the state of emergency.
