Views Upon The Formulation And Improvements Of Community Correction System In China

With the development of human civilization, the system of punishment in the countries all over the world has been under continuous innovation since 1970s. The most effective, most human and civilized approaches are being used in punishing the crimes and criminals. Community correction is one of these new approaches. In many countries, the number of criminals who receive this kind of correction has largely exceeded those who are kept in jail and the social benefit is quite satisfactory. Nowadays the approach of community correction in our country is still on trial. Compared with the situation in foreign countries, there is still a long way to go in such aspects as the applicability, range, method, effect and legislation. It needs to be contained into the overall aim of constructing a harmonious society and enhanced with a great effort. In view of this, the author, from the perspective of building a harmonious society, discusses the necessity of community correction in our country. And on the basis of the existing problems in the trial period, the author makes an initial research in the fundamental system in community correction in order to promote the progress in the punishment system reform and community correction.This article consists of three parts. The first part is a general introduction of community correction. On the basis of studying the concept of community correction, the author explains the urgency and feasibility of community correction in our country. In the second part the author, from the aspects of ideology, legal source, social recognition and management measures, points out some problems existed in carrying out community correction in our country and analyzes the current situation and restrictive factors in community correction. The third part proposes some suggestions on how to formulate and improve the system of community correction from the following aspects: innovating the concept of punishment, reforming and improving legislation of community correction, extending the application of community correction, improving and amplifying the working net, establishing a working system of coordination and cooperation among departments, improving the methods of correction, strengthening legal supervision and taking special measures against minors.
