Study On Legal System Of Environmental Administrative Guidance

Environmental problem has existed for a long time. Though human society is highly civilized now, the problem has still not been solved, but is instead becoming increasingly serious. As is proved in practice, the traditional mandatory environmental administrative management can not well meet the practical demand of environmental protection nowadays. Environmental administrative guidance, as a new method for environmental management, effectively overcomes the defect of traditional method of environmental administrative management and plays an important role in environmental administrative management. However, environmental administrative guidance has only been studied for a very short period and is immature in both theory and practice. Besides, mature and consummate system of environmental administrative guidance has not yet been established. This thesis is intended to analyze and expound important practical and theoretical issues of environmental administrative guidance, obtain a correct understanding of these issues, extract some regularities for implementing environmental administrative guidance and put forward corresponding advices for improvement, so as to make environmental administrative guidance and other environmental administrative management methods cooperate with and support each other, and make joint contributions to environmental protection and the realization of harmonious coexistence between human being and nature.The thesis consists of three parts: the introduction, the body and the conclusion. The body part is further divided into the following three chapters:Chapter 1 is an overview of the basic problems in the legal system of environmental administrative guidance. The author first discusses the relation between environmental problem and environmental administrative management, points out that environmental administrative guidance has now become an indispensable means of environmental administrative management, and redefines the concept of environmental administrative guidance.
