By sticking to Marxist fundamental principles and scientific spirit, this thesis checks and ponders over the process of development of our country's human rights protection, on the basis of occupying material fully and absorbing and using research achievements, regarding "Marxist standpoint on human rights as theoretic base.The whole thesis is divided into four parts, the main contents are, the first one, historical investigation on our country's human rights legislation: Summarizing the Chinese Communist Party's thoughts about the legislation of human rights; expounding the history of Chinese Communist Party's explorations on China's revolutionary line, striving for the success of revolution and the construction of socialism with Chinese characteristics, which is also the history of striving, protecting, realizing human rights and promoting the development of human rights. The second : The reasons and basic experience of the tortuous development of new China's human rights legislation and protection: analyzing the reasons of tortuous development of human rights legislation and protection; summarizing the basic experience of human rights legislation and protection. The third : The practical elements which restrict human rights legislation and the protection of human rights in our country ,including the developmental levels of economy, politics, culture, legislation and the consciousness of citizen's rights. All these practical elements are obstacles of protecting and improving human rights. The last: Consideration of our country's human rights legislation and the current state of the protection of human rights: offering the ways and measures to expand amplify and protect human rights, eliminate the obstacles we have mentioned.
