Research On Action For Enforcement Of Administrative Act

Administrative enforcement of non-litigation which is the main mode of cunent administrative enforcement in our country has played a decisive role in preventing administrative power from abuse and protecting the administrative relative person's right and interest. But the lack of reasonable design and procedural norm in the process cause the confusion of administrative enforcement of non-litigation in practice. Because this system has already sunk into a predicament in the fulfillment, it is necessary to reform and improve it. Aiming at the current problems of administrative enforcement of non-litigation, the writer will separate administrative enforcement of non-litigation into two parts, one part is the action for enforcement of administrative act and the other is handing over enforcement power to the administrative organization in order to make the court and the administrative organization play their own role. This article emphasizes the discussion about the action for enforcement of administrative act. This article is composed of eight parts.The first part is a general description of the action for enforcement of administrative act. In accordance with the material collected so far in the course of research, I will give a briefing on the status quo of the research on this topic, major questions in present research, focal points and methods adopted in my research.The second part analyzes the status quo of administrative enforcement of non-litigation and predicament during the period of circulation of administrative enforcement of non-litigation. It is inevitable to change administrative enforcement of non-litigation into the action for enforcement of administrative act.
